Terms of Use

01Parties and scope

These Terms of Use (the “Terms”) constitute the service agreement between [COMPANY NAME] (“Nodaform”, “we”) and the person (the “User”, “you”) using the nodaform.com website and the browser-based floor plan drawing service (the “Service”).

By creating an account or using the Service, you declare that you have read and accepted these Terms. If you purchase a paid plan, the Distance Sales Agreement and the Cancellation and Refund Policy apply in addition to these Terms. The processing of your personal data is explained in the KVKK (Turkish Personal Data Protection Law) Information Notice and the Privacy Policy.

The rights of users acting as consumers under Law No. 6502 on Consumer Protection and other mandatory legislation are reserved; no provision of these Terms shall be interpreted so as to limit those rights.

02Definitions

• Service: the floor plan drawing, furniture layout, building services, 3D view, drawing sheet, simulation, sharing and all related functions offered through nodaform.com.
• Account: the user account you create with an e-mail address and password, or with Google, in order to use the Service.
• Plan: the service levels offered as Free, Plus, Pro and Ultimate, whose scope and usage limits are set out on the Plans and Pricing page.
• User Content: the projects, plans, drawings, templates, logos, comments and other content that you enter into or create with the Service.

03Account

• You must be at least 16 years old to create an account. If you are under 18, you must obtain the consent of your parent or guardian before purchasing a paid plan.
• You agree to provide accurate and current information during registration and to keep this information up to date.
• Your account is personal. You are responsible for keeping your password confidential and for all activity carried out through your account. If you notice any unauthorized use, notify us immediately.
• If you sign in with Google, access to your Google account is subject to Google’s terms.
• If you open an account on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

04Scope of the Service

Depending on the plan, the Service offers functions such as dimensioned floor plan drawing, furniture layout, electrical and plumbing symbols, 3D view, drawing sheet output, structural pre-check, cost estimate, voltage and load calculation, BIM features, sharing and comments. Functions may be improved or changed over time, and new ones may be added.

You acknowledge that the Service requires an up-to-date browser and an internet connection, and that some functions (e.g. the 3D view) may perform differently depending on your device’s hardware.

05Plans, fees and usage limits

• The Free plan is free of charge and may be used indefinitely. Plus, Pro and Ultimate are paid plans offered as monthly or yearly subscriptions.
• The tools included in each plan and usage limits such as the number of projects are listed on the Plans and Pricing page. You agree not to attempt to circumvent these limits by technical means.
• If you move to a lower plan, your plans are not deleted; projects exceeding the new plan’s limit become read-only, and layers and outputs not included in the new plan are disabled.
• Prices of paid plans, the subscription period, automatic renewal, payment and the right of withdrawal are governed by the Distance Sales Agreement.
• We may change prices and plan contents with prospective effect. Changes do not affect a current subscription period that has already been paid for; paid subscribers are notified by e-mail at least [NOTICE PERIOD — e.g. 30 days] before renewal.

06Professional responsibility: calculations are for information only

• The structural pre-check, voltage and load calculation (breaker load, cable size, voltage drop), cost estimate, quantity take-off, clash detection and all similar calculations are based on simplified assumptions and are provided solely to give a preliminary indication.
• These calculations do not replace the designs and calculations required under the applicable zoning legislation, the Turkish Building Earthquake Code, the Regulation on Fire Protection of Buildings, the Regulation on Internal Electrical Installations and the relevant standards.
• Before any plan prepared with the Service is implemented or used in construction, renovation, structural, electrical or mechanical installation work, it is mandatory that a design be prepared and approved by an authorized, licensed architect and engineers of the relevant disciplines (civil, electrical, mechanical).
• It is your responsibility to have the accuracy of dimensions, area calculations and outputs verified on site by authorized persons before implementation.
• Subject to mandatory provisions of law, Nodaform cannot be held liable for damages arising from work carried out on the basis of calculation results or plans without authorized approval.

07Content ownership and license

Your plans belong to you

All rights in User Content belong to you or to the respective rights holders. Nodaform claims no ownership of User Content.

So that we can provide the Service, you grant us a worldwide, royalty-free, non-exclusive and non-transferable permission to store, process, reproduce and display User Content, and to show it to others on your instruction (e.g. via a share link), solely for the purpose of providing the Service. This permission ends when you delete the content or close your account, subject to statutory retention obligations and the process of deletion from backups within a reasonable period.

We use your User Content for marketing purposes only with your explicit permission.

Your responsibility

You represent that you have the right to use the logos, images, underlays and other content you upload to the Service, and that such content does not infringe the intellectual property, personality or personal data rights of third parties.

Nodaform’s rights

All intellectual and industrial property rights in the software, interface, design, logo, trademark, template gallery, furniture library and documentation belong to Nodaform or its licensors. Within the scope of your plan, you are granted a non-exclusive, non-transferable license, limited to the term of the agreement, to use the Service in your personal or commercial projects. You may freely use the templates and furniture objects in your own plans and may also use the outputs of those plans for commercial purposes; however, you may not distribute or sell the template and object library as a separate product.

Feedback

We may use your suggestions and feedback about the Service to improve the Service without incurring any obligation to you.

08Sharing and comments

• When you create a share link, anyone with the link may view or comment on the plan to the extent permitted by your plan and your sharing settings.
• You are responsible for whom you share the link with and for ensuring that the information in the plan is suitable for sharing. You may remove links at any time under My account › Sharing.
• You agree not to use expressions in your comments that are unlawful, contrary to public morals or that violate personality rights.

09Prohibited uses

When using the Service, you agree not to:

• upload or share content that is unlawful, infringing, misleading, defamatory or harmful;
• use content that infringes the intellectual property rights of others;
• attempt to circumvent the security of the Service or to access other users’ accounts or data;
• distribute malware, send automated requests that overload the Service, or perform unauthorized data scraping;
• attempt to circumvent plan limits and paid features by technical means;
• reverse engineer, decompile or copy the software, except where permitted by law;
• rent out or resell the Service or your account without authorization, or make your account available for shared use by more than one person;
• present outputs produced with the Service to third parties as if they were officially approved construction documents.

10Your data and backups

Your account and project data are stored on our servers; you can access them from different devices and browsers with the same account. To guard against possible disruptions, we recommend that you also regularly download important projects as project files (.json).

Once server-based storage is introduced, we will take reasonable measures to protect your data; however, it remains your responsibility to keep your own backup of your User Content.

11Service continuity and changes

We make reasonable efforts to provide the Service without interruption or errors; however, temporary interruptions may occur due to maintenance, updates, failures of infrastructure providers or force majeure. We announce planned maintenance in advance wherever possible.

We may change or remove a function of the Service. If a core function of your paid plan is permanently removed, your rights regarding the remaining subscription period are protected under the Cancellation and Refund Policy.

Unless agreed in a separate written agreement, the Service does not include any commitment to a specific availability level (SLA).

12Limitation of liability

• The Service is provided “as is” and “as available”. Except for warranties that must be given by law, no warranty is given as to the fitness of the Service for a particular purpose, the accuracy of calculation results or uninterrupted availability.
• Nodaform is not liable for indirect damages, loss of profit, loss of data (if you have not kept a backup), or damages arising from work carried out without authorized approval as described in Section 6.
• Nodaform’s total liability for direct damages is limited to the total amount you paid for the Service in the 12 months preceding the event giving rise to the damage.
• These limitations do not apply in cases of intent or gross negligence (Turkish Code of Obligations, Art. 115), to damage to personality rights or bodily integrity, or to consumers’ rights under mandatory legislation.

13Suspension and termination

• You may terminate the agreement at any time by deleting your account under My account › Settings. Cancellation of a paid subscription and refund terms are governed by the Cancellation and Refund Policy.
• If you seriously or repeatedly breach these Terms, use the Service for unlawful purposes or endanger its security, we may temporarily suspend your account or terminate the agreement, with prior notice where possible. In the event of unjustified termination, the fee for the unused paid period will be refunded.
• Upon termination, subject to legal requirements, you will be given a period of [PERIOD — e.g. 30 days] to export your data; at the end of this period, your data will be deleted.
• If we discontinue the Service entirely, we will announce this at least [PERIOD — e.g. 60 days] in advance and refund the fee for the unused paid period.

14Changes to the Terms

We may update these Terms due to legislative changes, new features in the Service or security requirements. We will announce material changes by e-mail or in-Service notification at least [NOTICE PERIOD — e.g. 30 days] before they take effect. If you do not accept the changes, you may close your account before the effective date; in that case, the fee for the paid and unused period will be refunded.

15Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye.

Users who are consumers may, in disputes within the monetary limits announced each year by the Ministry of Trade, apply to the Consumer Arbitration Committees at their place of residence or where the transaction took place, and, in disputes exceeding these limits, to the Consumer Courts after the mediation process required by law.

For disputes with users who are not consumers (merchants, organizations), the Courts and Enforcement Offices of [İSTANBUL (ÇAĞLAYAN)] have jurisdiction.

16General provisions and contact

• If any provision of these Terms is held invalid, the validity of the remaining provisions is not affected.
• Our failure or delay in exercising our rights does not constitute a waiver of those rights.
• You may not assign your rights and obligations under this agreement to another party without our prior written consent.
• Notices to you are sent to the e-mail address registered to your account or provided within the Service.
